Starting May 8, 2025, New York City’s lactation accommodation law will be updated to require employers with four or more employees to post their lactation room accommodation policy in a conspicuous place that’s accessible to all employees. The policy must also be posted on the employer’s intranet if they have one. These new posting requirements are in addition to the current requirement that employers provide the policy upon hire.
The law also requires that the policy be updated to include the state’s requirement to provide 30-minute paid lactation breaks and allow employees to use existing paid break or meal time for any additional time beyond the 30 minutes.
We expect that the NYC Commission on Human Rights will update its Model Lactation Accommodation Policies to reflect this change by the effective date of the law.
